TreadShield PLUS Road Hazard Protection Plan
Limited Warranty Terms & Conditions
Fairmount Tire & Rubber Inc. (“Fairmount” or “we” or “our”) provides this road hazard limited warranty under Fairmount’s TreadShield PLUS Road Hazard Protection Plan (“Warranty”). The Warranty is provided to the original purchaser (“you” or “your”) of the tires listed in an original purchase receipt from Fairmount and presented by you within the time limit specified below, and at the time you seek to claim coverage under this Warranty, provided you purchased for those tires the applicable Fairmount Road Hazard Protection coverage at the time of your original purchase (any such tires, the “Tire(s)”).
Scope of Coverage
This Warranty protects your Tires against “road hazard(s)” and “road hazard failure(s),” which are defined as unexpected, non-repairable/unserviceable damage caused to your Tires by potholes, nails, glass, debris, or other objects on the road.
Fairmount will replace your Tire free of charge if in Fairmount’s sole discretion, your Tire experiences a road hazard failure. This Warranty expires on the first to occur of the below dates:
Two (2) years from your original purchase
The tread on the tire is worn to 3/32” or less
This Warranty only applies to the original purchaser of the Tire. It automatically expires when the Tire is transferred to another vehicle. To the fullest extent of the law, loss of use of the vehicle or any other incidental or consequential damages such as inconvenience, etc., are expressly excluded from this Warranty and not compensated/covered.
You must promptly report Tire damage and present the Tire and original purchase receipt to Fairmount within ten (10) days of the road hazard failure.
Limitations
To maintain your eligibility under this Warranty, you must:
Rotate and balance your Tires at intervals recommended by the vehicle manufacturer;
Check and correct Tire alignment as necessary;
Maintain Tires at the vehicle manufacturer’s recommended inflation pressures;
Operate Tires only on public, maintained roads and not for racing, off-road driving, or other extreme uses outside normal operation; and
Not exceed the Tire’s load-carrying capacity or speed rating.
Tires damaged due to the following will not be covered under this Warranty:
Anything that is not determined by Fairmount in its sole discretion to be a road hazard failure, or any Tire impact with hazards beyond normal driving conditions; or
Accident, mechanical failure, fire, vandalism, chains, curbing, willful abuse, improper vehicle maintenance, or any irregular use of the vehicle.
To the fullest extent permitted by law and except for the Warranty above, Fairmount excludes and disclaims all other warranties concerning the Tires, express or implied, including without limitation any warranties that the Tires are fit for a particular purpose or cannot fail.
